My Pros and Cons in a small town PD.

Got the mail yesterday and the Insurance Companies petition to suspend my benefits has been responded to and a judge has been assigned..... now just waiting for our hearing date....

Once we have the date.... we will meet in front of the judge, and the insurance company will site RETURN TO WORK and FULL RECOVERY as reasons to suspend my benefits... we will argue that neither is true, and retaliate with written documentation from my treating physician as well as proof into my torn hip, in an attempt to expand the boundaries of the injury, since by the looks of it...the insurance company is not acknowledging the hip injury.....

My health... my career....lies in the hands of the Judge and "the system."

Havent checked back here for a few days, been real busy at work...

I hope, as we all here say, that the truth is what is found at that hearing. We all know you arent a liar, we just need them to know that.I hope that everything that can possibly go your way at that hearing, goes your way smoothly.... Fingers crossed bud...

Should be a slam dunk. An officer of the law in front of, well, the law. Just look at the judge as an third party with no dog in the fight. You'll lay out your case, the insurance co will lay out theirs. Judge will scold insurance company for wasting his time and making your life hell. Thank You Chris... I really hope its just that smooth.... IF so, I will get all my leave time back, and pulled back out of that BS Im doing now, I will be able to get the surgery on my hip and confirm one way or another if the hip was the issue or a secondary issue to the back,... and continue my healing....

Today, My nurse case manager called me and told me that the insurance company is pulling her from helping me....

My Atty let me know that this hearing in Jan is just the first step to that process, not to expect a decision till late 2013.... And there is no WAY I have that much LEAVE time .... so that mean once I run out.. they will work on terminating me...

Today the Boss , right before he left rudely told me that when other Officers are in the station, they hang around and talk to me 2 much!!!! SERIOUSLY... now when other less senior Officers come to me and discuss things, or I request leg work from the patrol guys (since Im in the Office) or even a friendly conversation... its now MY responsibility that other Officers are hanging around to much?!?!?!?!?!?

Damn dude, this is just a stupid situation all the way around. So much for "here's the problem, let's fix it." What happened to those days?

They know my hip is torn and they are cool with still ORDERING me to work full duty..... AS A COP!

Im pretty sure i wont be able 2 because when they do it...they will have "just cause" that their dr says there is nothing wrong with me...and they dont care what mine say.

I couldn't collect unemployment because i couldn't do my previous job and i was deemed disabled so they denied me it sucked .

Man, this is the shit-end of the stick no matter how you look at it... I don't know much about PDs, but can they not find a desk job role to transition you into while your hip is f'ed? At least until after the surgery and rehab is done? Just tossing out ideas, I don't know if you could swing that or if you'd even want to go that route. Hopefully humanity will come back to its senses soon and help you out man. My best wishes for your recovery and your career.

Thanks all.... just like last year.. they will manage to ruin the holidays....and cause more stress and issues than they did the year prior.....

LOL.... I know its a long thread , but the short version is:

Jan 26th into the 27th I hurt myslf during a slip at work... while spending a shift shoveling and and pushing cars out in our worst storm of the year.

Jan 27th ordered to work another shift even after reporting injury... could not get out of the tahoe, had to utilize our highway dept and other understanding Officers from other depts to help me....

Went to TWP Dr, and put on workmans comp till March 12th... Doctor would only give me meds... no actions.

March 13th, began light duty, desk work...Investigations...filing.... office shyt...(wells suited for it even with pain, np.)

April, TWP dr tells me he does not deny that I have pain, however he does not see anything in MRI, so I have to go back to work.... I get angry, and tell him... how do I do police work when I cant walk.. he advises me that was my issue to figure out, but the pain I am feelig is NOT work related...WTF!!! This is when I saw it was going to get shady.....

After 90 days of treatment at the TWP dr... I can pic my own Doc.... I meet with another Dr... he looks at MRI, and says I have arthritis in my joints and it was EXASERBATED by the slip and that is where the pain is coming from.. He says ...NO way should I be at work full duty....

Insurance company ignores TWP dr who says Im ok., and allows me to stay out based on new DR... I do months of Physical therapy.... aqua therapy and MANY steroid injections into my facet joints... my SI joints....and even epidurals.....BARELY any improvement.....

September... that Doctor says, "I am as good as I will get, I need to start figuring out what Im gonna do, cause I can never be a full duty cop again......" I dont like that answer or attitude.... soooooo I find another dr.

The first of three doctors at the same place I am being treated with now (they have a fellowship program so they have many NEW Doctors who are there for a year before moving on....)

This Dr, decides to start me on rounds of denervations.. kinda risky, basically going in and burning nerves to attempt to stop the pain.... not a fix for whats wrong, but something that should help.... 3 denervations do not help... nor do a TOTAL before and after this point of 23 steroid injections in different areas.......

October 14th.. I am approached by the Chief who tells me , NO MORE LIGHT DUTY... he is sending me home on Workmans Comp pay now.... Fine.... (for those that dont know....if they have work for me.. they cant get rid of me, because they can adapt to my injury... so him saying NO MORE LIGHT DUTY, means he is saying they can not adapt to my injury, so I know its the serious aim at geting rid of me...

From October 14th, several more injections...etc... and AGGRESSIVE Physical therapy.... STILL NO BETTER....

Between OCt 14th and Sept 9th, I see the insurance companies Dr for whats called an IME... its supposed to be an INDEPENDENT medical examination...paid for by the INSURANCE COMPANY... picked by the INSURANCE company.... and he reports directly to them....RIGHTTTT...

HIS FIRST REPORT... says "work related injury, requires continued treatment...."

After second appointment with him....

HIS SECOND REPORT... says Im faking and there is nothing wrong with me because nothing shows on my MRI, and I should take an FCE... FUNCTIONAL CAPACITY EXAMINATIONS..... like a long gym test to see what I can do.


I do his FCE on another date.... at the same Doctors facility..... The report by the people who give the test states that I am "GUARDED, and CAUTIOUS, and not trying 100%" (they forget to take into account I am still anemic after a week long hospital stay the week prior from another medical condition....)... however at the end of their report they write,"Officer Hanna can direct traffic, drive a vehicle, work investigations, etc, however by no means should he be put in any situation where he would need to physically exhert himself or any possibility where a physical aletercation may occur... he is ok for light to medium duty ONLY."


Weeks go by... and I am suddenly ordered back to work...FULL DUTY by the CHief. He tells me that I have been cleared by that IME Dr... I tell him My Dr says I am not... My attorney advises me that I must return or use my leave time to avoid dicipline.... so I go in on SEPTEMBER 9th 2012...... however because I am not qualified with my hand gun I can not be ordered out..... Once they qualify me on the handgun.,I will be ordered out....

I cant publically to into detail why... but I am still not qualified, so that is why I am riding a desk still.....

Recently... I had my chiropractor suggest something to my DR>.. and that is how we found my torn hip.....

WE are unsure whether the hip has been the issue all along and the pain radiates up and down my back.... or if it is because of almost 2 years of limping... but either way it is "work related."

I bring the arthogram report to the twp... the twp attorney... the insurance company...the chief.. etc.... however they are playing as if they have no idea that anything is going on.....

THAT catches you up to where several of my recent posts are... the insurance co has pulled my nurse case manager... they have PETITIONED TO SUSPEND MY BENEFITS, meaning they no longer want to take care of my medical work... so we now have to litigate just to keep me in care to hopefully get fixed to hopefully go back to work.... however... I cant do anything till it is deemed W/C.... and that process will take most of 2013... and I dont have enough time to use LEAVE TIME till it is resolved.... so in about 4 months... I will run out.. they will terminate me... and I will be fighting from a position of unemployment.......

AND ALL THIS over the holidays..... Im just fed up...

LOL...^^^^^THATS^^^^^ a long short version.

Well on one hand, that was certainly much easier than reading through 46 pgs. to get caught up to speed, but on the other hand, I stand behind my previous comments about the situation (even though I only had read the first couple pages and the last few pages). Try to keep your mind off it at least during the holidays so you can at least enjoy time with the family. No use banging your head against the wall right now since it sounds like everything's on hold for a while anyway.

With FELA (Federal Employers Liability Act) you go to your own doctor. Your employer is not allowed to have any contact with your doctor. Compensation is through the court system, decided by a jury, unless settled between you and your employer and is usually much greater than WC usually pays. I have never heard of someone being forced back to work while still suffering under FELA. Workers comp really gives the employer too much power.

workers comp laws most definitely protect the employer and the comp Insurence company and not the injured workers . during my case they lied and made up all kinds of fake shit to make me look bad and i was horrified. During, after and still to this day i feel like i was hit by a train hauling a million box cars at the speed of light.

I just hope that things get better soon for popo.

Soooo.... I went to the docs today...

He looked at the arthrogram imaging of my hip..... He is unsure that is the cause of my pain and does not think he wants to operate ....

He set me up with his spine specialist to take alook... starting to see the "round and round" coming up..... Ugh.

He is not sure it is the issue... not saying it is...not saying it isnt...

His concern is.... if we fix my hip, and it was not the issue...we put me through surgery, and the issue will remain and I will just continue to limp and cause the damage to the hip again.

Remember, we dont know if its THE issue... orrrrr if it was caused by WHATEVER the issue is.... ya know?

Much as it sucks, that does make sense to an extent. I would think that they would be leaning a little more towards doing the surgery, seeing as the injections you had in that area seemed to give you relief for a few days. And the fact that they weren't able to find anything physically

Thats EXACTLY what I said to him... I had 2 or 3 days of near 100% relief from that injection right up until I went back to Aggressive PT..... IDK if it played into it at all, but he talked to me and examined me in about 10 minutes, after I waited nearly 2 hours after my appointment to see him... and it was late friday before the weekend before X-mas.... I kinda feel like I got chinced for attention cause everyone in the office wanted OUT....

Ill go see the spine specialist.... and see what they have to say, Im always weary when one Dr pushes me to another Dr in the same office... Like, "Im to lazy to work on you, but I dont want your money to go anywhere else..."

Is this a new dr that you're seeing? If so, he may not have a feel for the last two years, and wants to send you to someone who's opinion he trusts, to make sure that what is in your medical records is accurate. I can see being cautious in this instance, especially if this guy has never seen you before. You may not have gotten chinced, it may have simply been the doctor not wanting to go any further until he was sure that that is absolutely the issue. As much as I know you want to get things rolling to get fixed, another pair of eyes can't hurt, and will either clear you hot for surgery, or maybe find another issue that was somehow missed. Either way, I think you're nearing the end game, at least as far as finally having a solution to your issues and getting them resolved.

In fact it is another Dr.... The Dr that is my treating physician sent me to a local surgeon to discuss the hip.... when we confirmed that my hip was torn... that Surgeon said he does not do arthroscopic surgery on the hip.... if he would do it at all, he would require fileting me... and Im not digging that.... so he ref'd me to this other Surgeon (an hour away) who does the hip surg arthoscopically... and that is who I just saw....

Ok, gotcha. In that case, I would say that the surgeon you just saw is covering his bases and having you see someone who's opinion he trusts. I'm sure you can understand the mentality of picking up something another officer had been working on, and back checking everything to make sure that there wasn't something that was missed and to get up to speed with exactly what is going on, using the file you got as a good starting point. I wouldn't sweat that part too much at this point.

It does make sense... thank you for making it clear. Im just really starting to come apart over it...especially with the hearing coming up on the 7th....
