A Florida man thought he was acting heroically, but as it turns out, he jumped the gun.
Michael Foster, 43, thought the worst when he spotted a man walking into a Walmart with a handgun holstered under his coat.
As you can see from the store's video above, Foster tackled the man from behind and put him in a chokehold.
According to a witness, 62-year-old Clarence Daniels pleaded with Foster to let him go, telling him he had a license to carry the weapon.
When police arrived, they confirmed that Daniels did have a permit to carry the gun, and Foster was arrested on a count of battery.
Police advise concerned citizens to call law enforcement, not take matters into their own hands.

From what I've read the carrier was holstering his pistol when getting out of the truck which is how it was seen. IMO it was both their faults. As a CHL holder it is your responsibility to keep your shit out of view of the public. This is also one of the many reasons why open carry is a bad idea.

I agree on open carry. But there are many times i am in the car and my piece is in my car mounted holster (more comfortable than sitting on it while driving).

So when i get where im going i remove it from car and into my small of the back holster.

I do try to be discrete tho.

Were the people who helped Foster charged as accessories?
I can identify with Foster a bit though. I called 911 twice in one month to report possible B&E in progress at neighbors' houses, but the cops never arrived. I actually saw a guy trying to get into the houses both times.

As with anything.... I believe this is a lesson on, first establish if there is a threat before responding as if there is one.....

I would of never tackled a guy with a gun even though that was a good take town. A 62 yr old with a holster most likely has a license and not going to cause any trouble. He should of called the police if he thought something was wrong. Stupid

Exactly why no one other than yourself and those closest to you that you trust should ever know you carry.

Well the "hero" in this story doesn't ever have to worry about being able to carry a gun himself now that he's gotten that charge on his record.

I'm sure it depends on the state, but here in VA it either has to be a felony, or a conviction that could land him in jail for more than a year.

Forget the jail/legal aspect of it, he is lucky the guy with the firearm never got the upper hand and drew on the attacker...

I'm sure it depends on the state, but here in VA it either has to be a felony, or a conviction that could land him in jail for more than a year.

I believe in FL a violent crime conviction will make you ineligible atleast for some period of time. Not to mention this man was 62 years old, but I'm unaware of the age threshold where the victim is classified as elderly and thus the penalty of the charge is increased.

Very true.

If someone not in a uniform tackled me to the ground I would assume the worst from a victim standpoint. That and the fact that an assumption could be made that the attacker could possess an intent to gain control of the firearm and turn it on me to "save the day"
