So I picked up a football card from ebay a few days back. just another Emmitt Smith BGS graded 9.5 card, so it's sealed in the case, serial numbered, etc. I paid a pretty penny for this one too.
It comes in, and I'm looking at it. And I notice that the upper "corner" (the card is cut in a triangle shape) was actually split and folded over when it was put in the case. Certainly NOT a BGS 9.5 card at this point no matter what the grading in the case says.

So I email the guy tonight, and here's his reply:
Just send card back with delivery confirmation and I will give you a refund plus your shipping. I am not willing to give discount because I have had many offers on this card including shows where they have seen card.

Now mind you, I offered him HALF of his set price auction as a best offer and it was accepted. And the attitude above just screams to me that he knew it was messed up in the first place.
I'm wondering how I should proceed. I wanted to ask for a partial refund, but apparently that's not in the cards. I don't want to let it go because this is the ONLY one of these cards I've ever seen come out with a 9.5 grade and I've been watching for a long time. So I'm in a conundrum. Do I not reply, not leave feedback, call it good, or do I press the issue?
