I just saw this on the Corvette forum, (no, I'm not a stuck up prick) and I was wondering if it's illegal.

I wonder if you are allowed to drive nekkid like that. No one can see you unless you're driving a Jeep with the doors off. Are you in public, or is your vehicle a private place. I believe my motorhome is private. Of course if a woman was around they'd probably get me for assault with a dead weapon.:cry:! Hey Popo, you around here? What is the scoop on motorhomes? We were on a trip out west and the girls would sit beside a picture window and drink a glass of wine during the day. Does that count as an open container? When my brother-in law- got done with his driving shift and I took over, he'd grab a beer before he took a nap. Are motorhomes held to the same standard as cars or is it just one of those gray areas that people don't seem to care as long you're not acting like a jerk. Just curious.

hellz ya! when the dude got out of the truck, threw his arms up in the air and didn't comply with the officers instructions to get out and put his hands on the back of the truck.. open game! Taze his ass! lol... although justified, probably doesn't qualify as naked guy wasn't armed... "bowed up" but not armed... comes down to personal perception at that point i guess... but still justified

I would say the motorhome thing would be illigal because of the open container laws. Im not sure if you can have an open container in a vehicle in other states but here in Ky they dont allow it.

Hey Popo, is naked the same as nekkid?? I don't know about Pennsylvania but many states allow open containers in the coach part of a motorhome but not in the cab area. I have a liquor cabinet that has probably 30 bottles of liquor and most of them have been opened. I would be in big trouble. Many states require a certain size motorhome with sinks, water, terlits, and all that kinda stuff. Motorhomes are sort of like a second residence, or so I've been told. I don't know about being naked in the coach part though. What say the police??

Well i have to tell you, I am not sure of the exact quantity, however transporting liquor across state lines is also illegal....
I think nekkid is the hillbilly spelling of naked....
And im pretty sure if there is a chance someone can see you, your expectation of privacy is decreased if not nill..... like being at home naked in front of an open window.... thats illegal, even though you would think you have a right to privacy in your home.....

Thanks Popo, I've done this motorhome thing for 35 years or so and have never had a problem so I guess it is a moot point. I just didn't know the law and have never thought to ask. As a LEO would you be allowed to search a motorhome as you would a car or would it be treated more like a residence and require a search warrant? I often wondered about it. Local LEO cannot come onto a documented boat but the Coasties can. I didn't know the difference between a boat and a car. Well....I know that on floats and one doesn't but I didn't mean it that way.;)

Honestly, thats a great question..... I never put any thought into it. basically because campers/RVs and 18 wheelers are such a LONG walk in traffic. lol I normally dont stop em.... however, I guess within the reach of the driver, I would still be able to assuming I have RS or PC
However, warrants are so easy to get (the on call judge loves me) I would just cover my ass and get one if I felt there was more worth looking into

Being naked in a vehicle is obviously illigal. But the better question to ask is... WHY IS SOMEONE NAKED IN A VEHICLE?!?!
My only reasonable explanation is that they're drunk.

As far as the search and seizure question asked. Here is how I look at it, if the motor home is driving down the road it's treated as a vehicle, if its parked at a camp ground, etc, it's a home. On a traffic stop search, if its plain view or consent, I wouldn't get a search warrant. Just my 2 cents...

I came across this case law and it should answer your question.
It's California v. Carney (1985), Basically says that the U.S. Supreme Court held that if police want to search a motor home that is capable of being driven away, police must have probable cause, but are not required to have a warrant.

ok, i still don't see why if a person is driving naked in there vehicle, why is it ilegal? if you are not bothering nothing then i don't see a problem. unless you were to make a scene or something.
